Please read these Terms & Conditions ("Terms") carefully before using DayByDay (the "Service"). By registering for an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and the operator of DayByDay ("we", "us", or "our"). Your continued use of the Service after any update to these Terms constitutes acceptance of the revised Terms.
2. Use of the Service
DayByDay is a private, invitation-only personal finance tracking application intended for household use. By using the Service you agree to:
- Provide accurate information when creating your account.
- Keep your login credentials confidential and not share them with others.
- Use the Service only for lawful personal or household financial record-keeping.
- Not attempt to reverse-engineer, copy, or interfere with the Service or its infrastructure.
- Not upload content that is unlawful, harmful, or infringes third-party rights.
3. Data You Provide
You retain ownership of the financial data and files you upload to the Service. By uploading data you grant us a limited, non-exclusive licence to store and process it solely for the purpose of providing the Service to you.
You are responsible for ensuring that any data you upload — including bank statements and transaction records — does not violate applicable laws or third-party agreements.
4. Data Handling & Privacy
We collect the minimum personal data necessary to operate the Service, which includes:
- Account information: username, hashed password, and optional display name.
- Financial data you choose to upload, such as bank statements and categorised transactions.
- Usage metadata, such as login timestamps and audit events, to support security and support.
We do not sell, rent, or share your personal data with third parties for marketing purposes. Data is stored securely and access is restricted to authorised administrators of the Service.
We retain your data for as long as your account is active. Upon account deletion, your data will be removed from active systems within a reasonable time, subject to any legal retention obligations.
5. Security
We implement reasonable technical and organisational measures to protect your data against unauthorised access, loss, or disclosure. However, no system is completely secure. You acknowledge that you use the Service at your own risk and that we cannot guarantee absolute security.
You are responsible for maintaining the security of your account credentials. If you suspect unauthorised access to your account, you must notify the administrator immediately and change your password.
6. Intellectual Property
All rights, title, and interest in the Service (excluding your data) — including software, design, text, and graphics — are owned by us or our licensors. Nothing in these Terms grants you a licence to use our intellectual property beyond what is strictly necessary to use the Service.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Nothing in the Service constitutes financial, legal, or tax advice. You should seek professional advice before making financial decisions.
8. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or business interruption — arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid for the Service in the twelve months preceding the claim, or (b) one hundred dollars (USD $100).
9. Termination
We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 6, 7, 8, and 10 survive termination.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the operator is based, without regard to its conflict-of-law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will increment the version number shown at the top of this document and, where practical, notify active users. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
